การจัดการศึกษาสำหรับเด็กไร้สัญชาติ

Abstract

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) ทราบสาเหตุของการจัดการศึกษาแก่เด็กไร้สัญชาติ 2) ทราบรูปแบบการจัดการศึกษาสำหรับเด็กไร้สัญชาติ สนามวิจัยที่เป็นกรณีศึกษา ได้แก่สถานศึกษาในสังกัดสำนักงานคณะกรรมการการศึกษาขั้นพื้นฐาน ที่มีนักเรียนเป็นเด็กไร้สัญชาติ จำนวน 5 โรงเรียน ใน 5 จังหวัด เก็บรวบรวมข้อมูลโดยใช้ แบบสัมภาษณ์ และแบบสังเกต เก็บข้อมูลระหว่างเดือน มิถุนายน 2557 ถึงเดือนมิถุนายน 2559 ผู้ให้ข้อมูลประกอบด้วยผู้บริหาร ครู นักเรียน คณะกรรมการสถานศึกษา ชุมชน เจ้าหน้าที่ฝ่ายปกครอง การวิเคราะห์ข้อมูลใช้ การวิเคราะห์เนื้อหา การจำแนกประเภทข้อมูล การเปรียบเทียบข้อมูลและการสร้างข้อสรุปแบบนิรนัย ข้อมูลที่ได้จากความคิดเห็นของผู้เชี่ยวชาญในการตรวจสอบรูปแบบการจัดการศึกษาสำหรับเด็กไร้สัญชาติ ใช้การวิเคราะห์เนื้อหาและสรุปความ วิธีการวิจัยแบ่งออกเป็น 2 ขั้นตอน ดังนี้ ขั้นตอนที่ 1 ศึกษาและวิเคราะห์เอกสาร ตรวจสอบหลักกฎหมาย ระเบียบที่เกี่ยวข้องกับการจัดการศึกษาสำหรับเด็กไร้สัญชาติ ขั้นตอนที่ 2 การสร้างรูปแบบการจัดการจัดการศึกษาสำหรับเด็กไร้สัญชาติ โดยนำข้อมูลจากทั้ง 3 ส่วน ได้แก่ การศึกษาเอกสารและงานวิจัยที่เกี่ยวข้อง ข้อมูลที่ได้จากการลงภาคสนาม ได้แก่ เอกสารของโรงเรียน การสังเกต การสัมภาษณ์ และความเห็นของผู้เชี่ยวชาญ นำมาวิเคราะห์สังเคราะห์โดยใช้ระเบียบวิธีวิจัยเชิงคุณภาพ แล้วนำมาสร้างรูปแบบการจัดการศึกษาสำหรับเด็กไร้สัญชาติ ผลการวิจัย พบว่า 1. สาเหตุของการจัดการศึกษาแก่เด็กไร้สัญชาติ มาจากสองสาเหตุ คือ ถูกกำหนดไว้ในกฎหมายทั้งในกฎหมายของประเทศไทยและกฎหมายมหาชน และเหตุผลทางด้านมนุษยธรรมทั้งที่ไทยเป็นภาคีในสนธิสัญญาต่างๆและไม่ได้เป็นภาคี 2. รูปแบบการจัดการศึกษาสำหรับเด็กไร้สัญชาติ ควรจัดการศึกษาพหุรูปแบบ คือการผสมผสานรูปแบบการจัดทั้งการศึกษาในระบบ การศึกษานอกระบบและการศึกษาตามอัธยาศัย เพื่อเป็นการสร้างโอกาสและทางเลือกทางการศึกษาให้แก่ผู้เรียน และตอบสนองความต้องการของชุมชนและนักเรียน ส่งเสริมการมีส่วนร่วมของทุกฝ่ายให้ร่วมกันจัดการศึกษาสำหรับเด็กไร้สัญชาติ The purposes of this research were to determine 1) the reason to provide the education for the stateless children 2) the education approach for the stateless children. The sample of this study were conducted at five schools, in five provinces, which were under the department of the Office of Basic Education Commission. Collected data by used, questionnaires and observations form from June 2014 to June, 2016. The participants were, the school directors, students, teachers, school committees, communities and public authorities. The researcher analyzed the content, clarified and compared the data before the deductive conclusion. By the way, the data which were the expert’s opinion in verifying the education approach for the stateless children were analyzed the content and concluded. The methodology of qualitative research was two steps. Step 1: to study and analyze the documents, such as laws and regulations related to the education for the stateless children. Steps 2: to create the education approach for the stateless children. The education approach for this group of students was formed from reviewed literatures, schools’ documents, observations interviews and expert opinion. This research found that 1. The causes of providing the education to the stateless children were; Thai and public laws and Thailand ratified some declarations and treaties as well. 2. Education approach for the stateless should multiple formats in formal, non-formal and informal education. To create opportunities and choice education to students and meet the needs of the community and students promote the participation of all parties to a common education for children stateless.
